RESOLUTION NO. RS2013-569

A resolution authorizing property located at 2801 and 2803 Smith Springs Road, 0 Starboard Court, and 0 Starboard Drive to be used as public park land pursuant to Section 2.206.010 of the Metropolitan Code.

WHEREAS, Resolution No. RS2012-424 was approved by the Metropolitan Council on September 18, 2012, to authorize the Director of Public Property to exercise an option to purchase real property located in Davidson County being Parcel No. 071 and 113 on Tax Map No. 136-00, and Parcel Nos. 167, 168, and 169 on Tax Map No. 136-14, for use as park land; and

WHEREAS, said property is zoned Specific Plan (SP) District to permit townhome residential uses; and

WHEREAS, use of the property for park purposes is not a permitted use under the SP zoning district in effect for the property; and

WHEREAS, Section 2.206.010 provides that Metropolitan Government departments, agencies, boards or commissions shall have the authority to be exempted from compliance with provisions of the Metropolitan Code for just cause upon adoption of a resolution of the Metropolitan Council approved by twenty-one affirmative votes; and

WHEREAS, since the property in question was specifically acquired to be used as public park land, it is fitting and proper that the Metropolitan Council exempt the property from the zoning restriction the use of the property to townhomes.

NOW, THEREFORE BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY THAT:

Section 1. Pursuant to Section 2.206.010 of the Metropolitan Code, the Metropolitan Council hereby approves the use of the following property as public park land:

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Metropolitan Board of Public Education and to the Director of the Department of Codes Administration.

Section 3. This Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
