RESOLUTION NO. RS2012-520

A resolution approving an interlocal agreement between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of the Metropolitan Government, and the City of Mt. Juliet for access to 800-MHZ system for emergency radio dispatching and response.

WHEREAS, the Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and the Electric Power Board of The Metropolitan Government of Nashville and Davidson County ("NES") jointly own and operate an emergency radio dispatch and response system utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission ("FCC"); and,

WHEREAS, the City of Mt. Juliet (“Mt. Juliet”) also has the use of 800-MHZ radio frequencies licensed by the FCC; and,

WHEREAS, the City of Mt. Juliet wishes to have access to the 800-MHZ radio frequencies licensed to the Metropolitan Government and NES; and,

WHEREAS, the Metropolitan Government, NES and Mt. Juliet have agreed upon the terms of an interlocal agreement to allow Mt. Juliet interoperability access to the 800-MHZ radio frequencies; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104, provides that interlocal agreements between governments may be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Interlocal Agreement by and between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and the City of Mt. Juliet for interoperability access to the 800-HMZ radio frequencies licensed to the Metropolitan Government and NES solely for public safety and governmental services purposes, a copy of which agreement is attached hereto and incorporated herein, be and the same is hereby approved, and the Metropolitan Mayor is hereby authorized to execute said Interlocal Agreement.

Section 2. That this resolution shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
