RESOLUTION NO. RS2012-513

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Jeanette Porter against the Metropolitan Government of Nashville and Davidson County for $37,500.00, and that said amount be paid out of the Judgments and Losses Fund and other appropriate funds.

WHEREAS, in December 2010, Jeanette Porter, then-Assistant Director of the Human Resources Division of the Davidson County Sheriff’s Office (“DCSO”), reported to several employees, including her direct supervisor, that certain DCSO employees had not been paid overtime that they were entitled to receive. No action was taken by any DCSO employee to whom Ms. Porter reported the information, or by Ms. Porter, to pay the employees, though the payment problem was corrected prospectively. In July 2012, Ms. Porter attempted to report the information to opposing counsel in a different DCSO lawsuit. After DCSO began investigating her conduct, Ms. Porter reported it again during the investigation. She was terminated after the investigation concluded.

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the employment discrimination claims of Jeanette Porter be compromised and settled for $37,500.00, and that this amount be paid from the Judgments and Losses Fund and other appropriate funds.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the employment discrimination claims of Jeanette Porter for the sum of $37,500.00, with said amount to be paid from the Judgments and Losses Fund and other appropriate funds.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
