RESOLUTION NO. RS2012-507

A resolution approving an agreement between the Harpeth Valley Utility District and the Metropolitan Government of Nashville and Davidson County to purchase drinking water during times of emergency or special need.

WHEREAS, Tenn. Code Ann. §§ 12-9-104 and 12-9-108 provide that any public agency may enter into an agreement with another public agency to complete joint service projects; and,

WHEREAS, under Tenn. Code Ann. § 12-9-104(b), municipalities such as the Harpeth Valley Utility District (HVUD) and the Metropolitan Government of Nashville and Davidson County (Metro) are public agencies; and,

WHEREAS, HVUD provides a safe, sanitary water supply to an area in the western part of Davidson County and parts of Williamson and Cheatham Counties; and,

WHEREAS, Metro provides a safe, sanitary water supply to areas in Davidson County; and,

WHEREAS, HVUD produces its water supply from a water purification plant in Davidson County; and,

WHEREAS, Metro produces its water supply from two water purification plants in Davidson County; and,

WHEREAS, Metro and HVUD recognize that the provision of safe, sanitary water can be affected or threatened, often suddenly and unexpectedly, in times of emergency or special need, and that it is beneficial for public agencies to cooperate with one another during such times; and,

WHEREAS, it is in the parties’ interest to enter into an agreement whereby Metro and HVUD may purchase drinking water from each other during times of emergency or special need; and,

WHEREAS, it is in the best interests of the citizens of the Metropolitan Government that the attached agreement between the Metropolitan Government and HVUD be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The attached agreement between the HVUD and the Metropolitan Government to purchase drinking water during times of emergency or special need, is approved.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.
