RESOLUTION NO. RS2012-498

A resolution approving Amendment Two (2) to a Safe Routes to Schools Grant Agreement between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for an extension of the completion date to October 20, 2013, for the construction of 1,570 linear feet of sidewalk along Oakwood Avenue in the vicinity of Tom Joy Elementary School, PIN 112312.00.

WHEREAS, The Metropolitan Government, acting by and through its Department of Public Works, previously entered into a grant agreement with the State of Tennessee, Department of Transportation (“TDOT”), for funding related to the construction of a sidewalk along Oakwood Avenue Sidewalk near Tom Joy Elementary, PIN 112312.00, approved by RS2010-1373 (“the Agreement”); and,

WHEREAS, the parties have previously amended the Agreement by altering Section D.37, relating to Federal Funding Accountability and Transparency Act, approved by RS 2010-1467; and,

WHEREAS, TDOT has agreed to amend Section B.2 of the Agreement to extend the completion date for the improvements contemplated by the Agreement to October 20, 2013; and,

WHEREAS, Amendment Two (2) to the Agreement needs to be executed to effectuate that extension; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment Two (2) to the Agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment Two (2) to the Safe Routes to Schools Grant Agreement, which shall replace Section B.2 of the Agreement to extend the project completion date to October 20, 2013, a copy of which is attached hereto and incorporated herein, by and between The State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
