RESOLUTION NO. RS2012-464

A resolution electing two members to the Board of Directors of The Health and Educational Facilities Board of The Metropolitan Government of Nashville and Davidson County, Tennessee.

WHEREAS, this Council has heretofore authorized, approved and confirmed the establishment of The Health and Educational Facilities Board of The Metropolitan Government of Nashville and Davidson County, Tennessee, and elected the members of the Board of Directors thereof; and

WHEREAS, Tennessee Code Annotated § 48-3-307, as amended, provides that all members of said Board of Directors shall be elected by this governing body; and

WHEREAS, Mr. Walker Batts has been nominated for one of said positions by Sean McGuire; and

WHEREAS, Ms. Susan Tinney has been nominated for one of said positions by Carter Todd; and

WHEREAS, an election has been conducted pursuant to the Rules of Procedure of the Council of The Metropolitan Government of Nashville and Davidson County on November 13, 2012, which resulted in the election of Mr. Walker Batts and Ms. Susan Tinney.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. Mr. Walker Batts, who is not an officer or employee of The Metropolitan Government of Nashville and Davidson County, Tennessee, is hereby elected a director of The Health and Educational Facilities Board of The Metropolitan Government of Nashville and Davidson County, Tennessee, for a six year term ending September 30, 2018; provided, however, that if at the expiration of said term of office of such person a successor thereto shall not have been elected, then such person whose term has so expired shall nevertheless continue to hold office until a successor shall have been elected.

SECTION 2. Ms. Susan Tinney, who is not an officer or employee of The Metropolitan Government of Nashville and Davidson County, Tennessee, is hereby elected a director of The Health and Educational Facilities Board of The Metropolitan Government of Nashville and Davidson County, Tennessee, for a six year term ending September 30, 2018; provided, however, that if at the expiration of said term of office of such person a successor thereto shall not have been elected, then such person whose term has so expired shall nevertheless continue to hold office until a successor shall have been elected.

SECTION 3. All Resolutions and orders, or parts thereof, in conflict with the provisions of this Resolution, are, to the extent of such conflict, hereby repealed.

SECTION 4. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
