RESOLUTION NO. RS2012-461

A resolution approving Amendment Number 1 to a grant agreement between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County for funding for roadscape improvements in the Hillsboro Village area, to be henceforth identified by PIN Number 105525.28, which extends the completion date for that project from November 13, 2011 to December 31, 2012.

WHEREAS, in RS2008-512, the Metropolitan County Council approved a grant agreement between the State of Tennessee, Department of Transportation (“TDOT”), and The Metropolitan Government for funding for roadscape improvements on 21st Avenue from Hillsboro Village to St. Bernard Park entrance, PIN Number 111005.00 (the “Agreement”); and,

WHEREAS, pursuant to Section B.2. of the Agreement, TDOT has granted a request to extend the completion date for the improvements contemplated in the Agreement from November 13, 2011 to December 31, 2012, but Amendment Number 1 to the Agreement needs to be executed to effectuate that extension; and,

WHEREAS, Amendment Number 1 would also delete from the Agreement the reference to TDOT PIN Number 111005.00 and replace it with PIN Number 105525.28; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment Number 1 to the Agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment Number 1 to the Agreement between TDOT and The Metropolitan Government, to replace the Agreement’s PIN Number with 105525.28 and to extend the completion date for the project from November 13, 2011 to December 31, 2012, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
