RESOLUTION NO. RS2012-441

A resolution approving Amendment Number 1 to a grant agreement between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County for funding for improvements on Shelby Avenue Continuation / Gateway Boulevard / Korean Veterans Boulevard from 4th to 8th Avenues South, Pin Number 113441.00, which extends the completion date referenced in that agreement from October 1, 2012 to October 1, 2017.

WHEREAS, in RS2010-1106, the Metropolitan County Council approved a grant agreement between the State of Tennessee, Department of Transportation (“TDOT”), and The Metropolitan Government for funding for improvements to Shelby Avenue Extension / Gateway Boulevard / Korean Veterans Boulevard from 4th to 8th Avenues South (the “Agreement”); and,

WHEREAS, pursuant to Section B.2. of the Agreement, TDOT has granted a request to extend the completion date for the improvements contemplated in the Agreement from October 1, 2012 to October 1, 2017, but Amendment Number 1 to the Agreement needs to be executed to effectuate that extension; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment Number 1 to the Agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment Number 1 to the Agreement between TDOT and The Metropolitan Government, to extend the completion date referenced in the Agreement from October 1, 2012 to October 1, 2017, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
