RESOLUTION NO. RS2012-428

A resolution authorizing the parking of vehicles at the former Stokes Middle School property located at 3701 Belmont Boulevard pursuant to Section 2.206.010 of the Metropolitan Code.

WHEREAS, the Metropolitan Board of Public Education (“the Board”) maintains control over the former Stokes Middle School property located at 3701 Belmont Boulevard; and

WHEREAS, the Board has permitted Lipscomb University to use the former Stokes Middle School property for overflow parking of vehicles; and

WHEREAS, the use of the former Stokes Middle School property for parking is technically not a permissible use of the property under the Metropolitan Zoning Code; and

WHEREAS, Section 2.206.010 provides that Metropolitan Government departments, agencies, boards or commissions shall have the authority to be exempted from compliance with provisions of the Metropolitan Code for just cause upon adoption of a resolution of the Metropolitan Council approved by twenty-one affirmative votes; and

WHEREAS, in recognition of the contributions Lipscomb University has made to Metropolitan Nashville Public Schools, especially through its College of Education, it is fitting and proper that Lipscomb University be allowed to use the former Stokes Middle School property for overflow parking for a limited duration.

NOW, THEREFORE BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY THAT:

Section 1. Pursuant to Section 2.206.010 of the Metropolitan Code, the Metropolitan Council hereby approves the use of the former Stokes Middle School property located at 3701 Belmont Boulevard for the overflow parking of motor vehicles by Lipscomb University for a period not to exceed two (2) years from the date of approval of this Resolution, subject to the following conditions precedent:

1. Lipscomb University shall file an application with the Metropolitan Department of Codes Administration for a permit to construct a parking lot on the former Stokes Middle School property.
2. Lipscomb University shall submit a site plan to the Department of Codes Administration for the area to be used for parking, which shall comply with the parking area design standards and landscaping standards set forth in the Metropolitan Zoning Code.
3. Lipscomb University shall enter into an agreement with the Board detailing the terms and conditions for the use of the former Stokes Middle School Property.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Metropolitan Board of Public Education and to the Director of the Department of Codes Administration.

Section 3. This Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
