RESOLUTION NO. RS2012-417

A resolution approving an interlocal agreement between the Metropolitan Government of Nashville and Davidson County by and through the Emergency Communications Center and the Emergency Communications District and The City of Brentwood Emergency Communications District to address gaps and overlaps existing in the emergency service zones (ESZ) and/or emergency service numbers (ESN).

WHEREAS, Tennessee Code Annotated Sections 12-9-101 et seq., authorizes public agencies to enter into agreements for joint undertakings, subject to approval by Resolution of Council; and,

WHEREAS, The Emergency Communications Center (“ECC”) and the Emergency Communications District (“ECD”) of The Metropolitan Government of Nashville and Davidson County (“Metro”) were created and established pursuant to T.C.A. § 7-86-101, et seq.; and,

WHEREAS, it has been determined that there are currently certain gaps and overlaps existing in the emergency service zones (“ESZ”) and/or emergency service numbers (“ESN”); and,

WHEREAS, the State of Tennessee has initiated its Next Generation 911 program in an effort to provide a state-of-the-art network to improve public safety by increasing the reliability of the 911 system statewide and moving the systems from analog to digital; and,

WHEREAS, the State of Tennessee’s Next Generation 911 program requires identifying where the gaps and overlaps in ESZs and ESNs exist, and identify which government entity will take 911 calls where such gaps and overlaps have been identified; and,

WHEREAS, the interlocal agreement entered into between Metro by and through the ECC and ECD and the City of Brentwood by and through its Emergency Communications District, attached hereto, specifies the parties’ roles and responsibilities with regard to addressing the identified gaps and overlaps existing in the ESZs and/or ESNs; and,

WHEREAS, it is in the best interest of the citizens of The Metropolitan Government of Nashville and Davidson County that this interlocal agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the interlocal agreement entered into between and among The Metropolitan Government of Nashville and Davidson County by and through the Emergency Communications Center and the Metropolitan Nashville and Davidson County Emergency Communications District and the City of Brentwood by and through its Emergency Communications District, attached hereto, a copy of which is attached hereto and incorporated herein, is hereby approved, and the is hereby authorized to execute the same.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
