RESOLUTION NO. RS2012-370

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Peggy Duncan Mathes, Administrator of the Estate of Roy Glenn Hall, Jr., against the Metropolitan Government of Nashville and Davidson County and Corrections Officers Scott Arnold, Lamondo Brown, Elsie Noel, and Micah Nowack for $10,000.00, and that said amount be paid out of the judgments and losses fund.

WHEREAS, on May 19, 2009, Roy Glenn Hall, Jr. was arrested and booked into the Davidson County Criminal Justice Center on two capias misdemeanors. Five days later, on May 24th, Mr. Hall was found unresponsive on the floor of his cell. Mr. Hall died of a perforated duodental ulcer with acute peritonitis, which Plaintiff contends is a treatable medical condition.

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the personal injury claims of Peggy Duncan Mathes, Administrator of the Estate of Roy Glenn Hall, Jr., be compromised and settled for $10,000.00, and that this amount be paid from the Judgments and Losses Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the personal injury claims of Peggy Duncan Mathes, Administrator of the Estate of Roy Glenn Hall, Jr., for the sum of $10,000.00 with said amount to be paid from the Judgments and Losses Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
