RESOLUTION NO. RS2012-354

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Byron V. Bush against the Metropolitan Government of Nashville and Davidson County in the amount of $17,332.08, and that said amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on September 13, 2011, a vehicle owned by the Metropolitan Government and operated by a Metropolitan Nashville Police Department employee struck the vehicle in which Byron V. Bush was driving, resulting in personal injury to Mr. Bush and property damage to his vehicle; and,

WHEREAS, after investigation, the Department of Law believes the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the personal injury claim of Bryon V. Bush be compromised and settled for $1,590.00 and the property damage claim be compromised and settled for $15,742.08 for a total of $17,332.08 and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Byron V. Bush for the sum of $17,332.08 with said amount to be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
