RESOLUTION NO. RS2012-352

A resolution authorizing the Director of Public Property, or his designee, to exercise options to purchase real property for use in the Whites Creek greenway system (Proposal No. 2012M-023PR-001).

WHEREAS, pursuant to the terms of the agreements attached hereto and incorporated herein as Exhibits A, B, C, and D to this resolution, the Metropolitan Government holds options to purchase certain property abutting Whites Creek; and

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council; and,

WHEREAS, pursuant to Section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated options (Exhibits A, B, C, and D) to acquire real property located in Davidson County being Davidson County Tax Map No. 049.00, Parcels 094.00, 306.00, 307.00 and 308.00, and incorporated into this resolution by reference; and

WHEREAS, the Metropolitan Board of Parks and Recreation has approved the purchase of the Property; and,

WHEREAS, portions of the properties will be used to construct, operate and maintain portions of the greenway system; and

WHEREAS, it is in the best interest of the citizens of the Metropolitan Government to approve the purchase of said property;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to exercise the options to purchase the properties (Map 49, Parcels 94.00, 306.00, 307.00 and 308.00) as shown in Exhibits A, B, C and D and to execute the necessary documents pertaining thereto.

SECTION 2. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
