RESOLUTION NO. RS2012-342

A resolution accepting the resignation of John Arriola from his position as County Clerk of Davidson County.

WHEREAS, on June 25, 2012, John Arriola resigned from his elected position as County Clerk for Davidson County; and,

WHEREAS, on June 25, 2012, District Attorney General Victor S. Johnson III submitted a letter to Metropolitan Vice Mayor Diane Neighbors giving notice of Mr. Arriola’s decision to resign from the office of County Clerk of Davidson County, effective June 29, 2012; and,

WHEREAS, pursuant to Article VII, Section 2 of the Tennessee Constitution, vacancies in county offices are to be filled by the county legislative body until the next election occurring after the vacancy; and,

WHEREAS, the County Clerk of Davidson County is a county office for purposes of Article VII, Section 2 of the Tennessee Constitution; and,

WHEREAS, the Metropolitan Council desires to accept the resignation of John Arriola as the County Clerk of Davidson County and commence the process for filling the vacancy in accordance with the Council Rules of Procedure.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council hereby accepts the resignation of John Arriola from the office of County Clerk of Davidson County.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to District Attorney General Victor S. Johnson III, Director of Law Saul Solomon, Tennessee Attorney General Robert E. Cooper, and to John Arriola.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
