RESOLUTION NO. RS2012-309

A resolution authorizing the execution of a Supplemental Agreement with CSX Transportation, Inc., allowing the Department of Water and Sewerage Services to construct and maintain water lines in the railroad right-of-way south of the intersection of Herman Street and 17th Avenue North.

WHEREAS, CSX Transportation, Inc. proposes to supplement an existing 1926 license agreement with the Department of Water and Sewerage Service (Metro Water Services), to provide for Metro Water Services to renew its water line in the railroad right-of-way South of the intersection of Herman Street and 17th Avenue North, by constructing and maintaining a new water line beneath a previously existing one in that location, and to abandon in place the existing one, pursuant to the terms of the Supplemental Agreement, attached in substantial form as Exhibit A; and,

WHEREAS, Ordinance No. O98-1393 authorizes the Metropolitan Government of Nashville and Davidson County to enter these types of agreements with CSX for water and sewer line construction by resolution; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Supplement Agreement between the Metropolitan Government of Nashville and Davidson County and CSX Transportation, Inc., attached hereto in substantial form as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute it.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
