RESOLUTION NO. RS2012-296

A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase real property (Map 094-00-0 Parcels 24.00, 29.00 and 39.00) for the use and benefit of the Metropolitan Department of Water and Sewerage Services (Proposal No. 2012M-017PR-001).

WHEREAS, pursuant to the terms of the agreement attached hereto and incorporated herein as Exhibit A to this resolution, the Metropolitan Government holds an option to purchase certain real property known as approximately 125.85 acres at 0 Pumping Station Rd., 1214 Lebanon Pike and 1450 Lebanon Pike; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan government at a fixed price, subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council; and,

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (Exhibit A) to acquire real property located in Davidson County being an approximately 125.85 acres known as Davidson County Tax Map No. 094-00-0 Parcels 24.00, 29.00 and 39.00, attached hereto and incorporated herein as Exhibit 1 to the option agreement; and,

WHEREAS, it is in the public interest that property or easements be acquired to permit the construction or other use of water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances within the area designated for the construction of Project No. 12-WG-0046, Land Acquisition for 0, 1214, 1450 Lebanon Pike; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County that the purchase of this property be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property Administration, or his designee, is hereby authorized to exercise the option (Exhibit A) to acquire the property (a portion of Map 094-00-0 Parcels 24.00, 29.00, and 39.00) as shown in Exhibit 1 and to execute the necessary documents pertaining thereto.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
