RESOLUTION NO. RS2012-294

A resolution approving an agreement between the Madison Suburban Utility District and the Metropolitan Government of Nashville and Davidson County for reading and maintaining water consumption meters and disconnecting water service.

WHEREAS, the Metropolitan Government of Nashville and Davidson County (“the Metropolitan Government”) provides sewer transportation and treatment services to Madison Suburban Utility District (“MSUD”) customers; and,

WHEREAS, the Metropolitan Department of Water and Sewerage Services has requested that the Metropolitan Government enter into the attached cooperative agreement with the MSUD under which the MSUD would read and maintain water consumption meters and disconnect water service, as needed, for a fee of forty-five cents ($0.45) per water consumption meter reading; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., authorizes political subdivisions of the state to enter into cooperative agreements by resolution of the local governing body; and,

WHEREAS, it is in the best interests of the citizens of the Metropolitan Government that the attached agreement between the Metropolitan Government and MSUD be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The attached agreement between the MSUD and the Metropolitan Government for reading and maintaining water consumption meters and disconnecting water service, as needed, is approved.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.
