RESOLUTION NO. RS2012-263

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into Utility Relocation Contract No. 7878 with the State of Tennessee, Department of Transportation, Project No. 19010-2162-44, to construct PIN Number 102488.06, I-65 Trinity Lane to Dickerson Road in Nashville.

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”) plans to construct State Project No. 19010-2162-44 in Davidson County; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville and Davidson County to approve an agreement with TDOT by resolution; and,

WHEREAS, the Metropolitan Department of Water and Sewerage Services plans to construct the utility work described in the attached contract and identified as Project No. 12SG0002 and 12WG0006 in Capital Improvement Budget No. 09-WS-0016; and,

WHEREAS, it is in the interest of the Metropolitan Government that this utility work be carried out in the State project; and,

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 7878, attached hereto as Exhibit A, TDOT will reimburse The Metropolitan Government of Nashville and Davidson County for the cost of the utility work, currently estimated to be $132,064.57.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Utility Relocation Contract No. 7878 with TDOT, attached hereto as Exhibit A and incorporated herein by reference, is approved and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the Director of Water and Sewerage Services is authorized to complete and sign additional documents necessary to implement the Local Government Investment Pool Program, relative to this State project.

Section 3. That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
