RESOLUTION NO. RS2012-247

A resolution approving an intergovernmental agreement between The City of Oak Hill and The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan General Sessions Court and Metropolitan Nashville Police Department, permitting the enforcement of The City of Oak Hill’s ordinances as contemplated by Tennessee Code Annotated § 12-9-104 (A)(1).

WHEREAS, the Charter of the Metropolitan Government creates a Metropolitan General Sessions Court, in Part IV of which are currently tried citations for violations of Metropolitan Government ordinances; and,

WHEREAS, the Charter of the Metropolitan Government creates a Metropolitan Nashville Police Department, which is the chief law enforcement agency for Davidson County; and,

WHEREAS, The City of Oak Hill, a municipality entirely within Davidson County, has adopted various ordinances applicable within its corporate limits; and,

WHEREAS, Tennessee Code Annotated Section § 12-9-104 (A)(1) authorizes a municipality to contract with the county in which it is located to provide for the enforcement of its ordinances by and through the county’s general sessions court and chief law enforcement agency; and,

WHEREAS, the parties seek an agreement that will permit the efficient and effective enforcement of The City of Oak Hill’s ordinances as contemplated by Tennessee Code Annotated § 12-9-104 (A)(1).

WHEREAS, it is in the interest of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between The City of Oak Hill and The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan General Sessions Court and Metropolitan Nashville Police Department, permitting the enforcement of Oak Hill’s ordinances as contemplated by Tennessee Code Annotated § 12-9-104 (A)(1), a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
