RESOLUTION NO. RS2012-246

A resolution approving the Third Amended Final Agreement with the United States Department of Justice.

WHEREAS, the Metropolitan Government of Nashville and Davidson County, Tennessee (“Metro”) and the United States Department of Justice (“DOJ”) previously entered into a Final Settlement Agreement in 2003, as approved by Resolution No. RS2003-1481, regarding compliance with the Americans with Disabilities Act (“Final Settlement Agreement”); and,

WHEREAS, by Resolution No. RS2006-1353 the Metropolitan Council approved an Amendment to the Final Settlement Agreement with the United States Department of Justice extending the term of the Final Settlement Agreement through June 1, 2009; and,

WHEREAS, by Resolution No. RS2009-913 the Metropolitan Council approved a Second Amendment to the Final Settlement Agreement with the United States Department of Justice extending the term of the Final Settlement Agreement through June 1, 2012 (“Second Amended Agreement”); and,

WHEREAS, that Second Amended Agreement by its terms expires in June 1, 2012; and,

WHEREAS, the parties now wish to continue their compliance with the terms of the Final Settlement Agreement, as set forth in the Third Amended Final Agreement attached hereto and incorporated herein; and,

WHEREAS, approval of the Third Amended Final agreement is in the best interests of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Third Amended Final Agreement between the Metropolitan Government of Nashville and Davidson County and the United States Department of Justice, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
