RESOLUTION NO. RS2012-215

A resolution approving an intergovernmental agreement between the State of Tennessee, Department of Health, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for the provision of issuance of certificates from the birth record database.

WHEREAS, Metropolitan Charter Section 10.104 provides that the Board of Health has the duty to contract for such services as will further the program and policies of the board, subject to confirmation by Resolution of Council; and,

WHEREAS, the State of Tennessee, Department of Health, is authorized by Tennessee Code Annotated, Section 68-3-101 et seq. to maintain vital records of persons born in Tennessee; and,

WHEREAS, the State of Tennessee, Department of Health, is authorized by Tennessee Code Annotated, Section 68-3-204 to issue reproductions of the original birth record; and,

WHEREAS, the State of Tennessee, Department of Health, maintains a birth record database (Automated Index Retrieval System, (AIRS)); and,

WHEREAS, it is a benefit to the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the intergovernmental agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the State of Tennessee, Department of Health, for the provision of issuance of certificates from the birth record database, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2: That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
