RESOLUTION NO. RS2012-212

A resolution authorizing the Metropolitan Mayor to submit Substantial Amendments to the 2011 and 2012 Annual Updates to the Consolidated Plan for Housing and Community Development programs to the U.S. Department of Housing and Urban Development.

WHEREAS, the Metropolitan Development and Housing Agency (“MDHA”) is responsible for the preparation of the Consolidated Plan for Housing and Community Development programs for The Metropolitan Government of Nashville and Davidson County; and

WHEREAS, the Metropolitan Council approved Ordinance BL 2009-599 authorizing the Mayor to submit the 2010-2015 Five Year Consolidated Plan for Housing and Community Development; and

WHEREAS, HUD requires an annual action plan describing how federal funds will be used each year to carry out the strategies and programs outlined in the Five Year Consolidated Plan, including expenditures of the Emergency Solutions Grant (“ESG”); and

WHEREAS, the Metropolitan Council approved Resolution No. RS2010-1486 and Resolution No. RS2011-116 authorizing the Mayor to submit the 2011 Annual Update and 2012 Annual Update to the Five Year Consolidated Plan, respectively; and

WHEREAS, HUD requires substantial amendments to the 2011 and 2012 Annual Updates incorporating new ESG regulations in order to receive the second allocation of 2011 ESG funds and the 2012 allocation of ESG funds (“Substantial Amendments”); and

WHEREAS, Substantial Amendments to the 2011 and 2012 Annual Updates have been prepared in accordance with the ESG Interim Rule and federal regulations regarding citizen participation; and

WHEREAS, the public comment period will conclude on April 16, 2012, at 7:00 p.m., and a public hearing on the Substantial Amendments was held on March 29, 2012, at the Randee Rogers Training Center, 1419 Rosa L. Parks Boulevard; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Mayor is hereby authorized to submit Substantial Amendments to the 2011 and 2012 Annual Updates to the 2010-2015 Five Year Consolidated Plan for Housing and Community Development to the U.S. Department of Housing and Urban Development.

Section 2. Drafts of the Substantial Amendments incorporating the ESG Interim Rule for the expenditure of ESG funds for 2011 and 2012 are attached hereto and made a part of this Resolution.

Section 3. The Metropolitan Development and Housing Agency is authorized to administer the Consolidated Plan on behalf of the Metropolitan Government of Nashville and Davidson County.

Section 4. The local match required for ESG funds will be provided by local non-profit organizations selected as sub-grantees.

Section 5. The Metropolitan Council expressly withholds any approval for the expenditure of funds associated with the ESG program for any acquisition of real property by use of eminent domain, which is already restricted by federal law.

Section 6. This Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
