RESOLUTION NO. RS2012-206
A resolution approving an application for a grant from the Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County and authorizing the acquisition and removal of 25 houses located in various floodway and floodplain areas in Davidson County.
WHEREAS, the Metropolitan Council previously enacted Ordinance BL2010-765 which authorized the Metro Water Services Department to apply for federal and state funds to acquire interests in and demolish flood-damaged properties pursuant to a hazard mitigation grant program upon approval of a resolution by the Metropolitan Council receiving at least twenty-one affirmative votes which identifies the specific parcels to be acquired and the maximum price to be paid for each parcel; and,
WHEREAS, the Tennessee Emergency Management Agency is accepting grant applications for home buyouts in an amount not to exceed $3,995,600.00, with a required cash match of $570,800.00, to The Metropolitan Government of Nashville and Davidson County for the purchase and removal of 25 houses located in various floodway and floodplain areas throughout Davidson County; and,
WHEREAS, the Metro Water Services Department has prepared the Metropolitan Government’s application for this portion of the hazard mitigation grant program including identification of the specific parcels and the maximum amount to be paid for each parcel, a copy of which application, including details on the specific parcels, is attached hereto; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this grant application be approved and submitted and that the Metro Water Services Department be authorized to acquire and demolish the specific properties included in the application.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan Government’s application for a grant from the Tennessee Emergency Management Agency, for the purchase and removal of 25 houses located in various floodway and floodplain areas throughout Davidson County, a copy of which is attached hereto and incorporated herein, is hereby approved, and The Metropolitan Government of Nashville and Davidson County is authorized to submit said application to the Tennessee Emergency Management Agency.
Section 2. That, notwithstanding the provisions of Section 2.24.250.F of the Metropolitan Code to the contrary, the Metro Department of Water Services is hereby authorized to acquire interests in the real property identified in the application, attached hereto and incorporated herein, and to execute all other necessary actions pursuant to the hazard mitigation grant program using federal and/or state grant funds received by the Metropolitan Government for such purpose.
Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
