RESOLUTION NO. RS2012-170

A resolution authorizing the acquisition of an additional easement for use in Project No. 10-SG-0083, Lakewood Laterals and Rehabilitation (Proposal No. 2011M-008ES-002).

WHEREAS, Ordinance No. BL2011-36 approved the acquisition of easements for use with water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances within the area designated under Project No. 10-SG-0083, Lakewood Laterals and Rehabilition, and provided that acquisition of additional or different easements or property rights be approved by resolution; and,

WHEREAS, Project No. 10-SG-0083, Lakewood Laterals and Rehabilitation, has been funded under Capital Improvements Budget No. 09WS0020; and,

WHEREAS, The Metropolitan Planning Commission approved this acquisition on December 16, 2011, Proposal No. 2011M-008ES-002.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property Administration is hereby authorized and directed to acquire by negotiation or take by condemnation, if necessary, the additional easement or property listed below to use with water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances, the initial such project being Project No. 10-SG-0083, the same being for a public purpose and the public convenience requiring it.

Section 2. The additional easement or property to be acquired is shown on the plans for Project No. 10-SG-0083, Lakewood Laterals and Rehabilitation, on record in the office of the Director of the Department of Water and Sewerage Services and incorporated herein, and listed by property address and map and parcel number as follows:

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
