RESOLUTION NO. RS2011-80

A Resolution approving an interlocal agreement between the Emergency Communications District for Nashville and Davidson County and The Metropolitan Government of Nashville and Davidson County for partial funding of an upgrade to the 800MHZ simulcast trunk radio system for emergency dispatch and response.

WHEREAS, the Emergency Communications District for Nashville and Davidson County was established pursuant to Tennessee law to secure for and provide to the public more efficient emergency service in the form of enhanced 911 services; and,

WHEREAS, the Metropolitan Government has contracted for services to upgrade its integrated digital 800MHZ radio system and most of the improvements are for the purpose of enhancing emergency dispatching services; and,

WHEREAS, the upgrade to the 800MHZ radio system will significantly improve the scope and efficiency of the 911 services provided to the residents of Davidson County; and,

WHEREAS, the Emergency Communications District has the powers of a municipality under Tennessee law by virtue of Tennessee Code Annotated section 7-86-106 and has agreed to assist the Metropolitan Government in financing the upgrade to the dispatching functions of the 800MHZ radio system; and,

WHEREAS, Tennessee Code Annotated section 12-9-101, et seq. grants Tennessee municipalities the authority to enter into interlocal agreements to operate common projects and achieve common objectives subject to the approval of their respective governing bodies or otherwise as provided by law; and,

WHEREAS, the Board of the Emergency Communications District has approved an Interlocal Agreement with the Metropolitan Government to assist in the financing of the upgrade to the 800MHZ radio system; and,

WHEREAS, it is in the best interest of the Metropolitan Government that the Interlocal Agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Interlocal Agreement by and between The Metropolitan Government of Nashville and Davidson County and the Emergency Communications District for Nashville and Davidson County (“ECD”), whereby the ECD will assist the Metropolitan Government in financing the upgrade to the digital 800MHZ Simulcast Trunk Radio System, in an amount not to exceed Twenty Five Million, Nine Hundred Ten Thousand Dollars ($25,910,000), is approved, and the Metropolitan Mayor is authorized to execute the Interlocal Agreement. A copy of the Interlocal Agreement is attached hereto and made a part of this Resolution.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
