SUBSTITUTE RESOLUTION NO. RS2011-78

A resolution authorizing the Director of Public Property to exercise an option to purchase property for use in a public project for the Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new Fire Station in the Joelton area ( Proposal No. 2011M-020PR-001).

WHEREAS, pursuant to the terms of the agreements attached hereto and incorporated herein as Exhibit A to this resolution, the Metropolitan Government holds an option to purchase certain property known as part of 3715 Old Clarksville Pike in Joelton; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council; and,

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (EXHIBIT 1) to acquire real property located in Davidson County being a portion of Map No. 021-00-0, Parcel 036.00, as approximately shown on EXHIBIT 2 incorporated into this resolution by reference; and,

WHEREAS, under Section 8.302 of the Metropolitan Charter, the Metropolitan Fire Department is charged with the responsibility of protecting against fire within the urban services district and within other areas covered by contracts authorized by ordinance; and,

WHEREAS, it is in the public interest that certain property, identified as a portion of Parcel 036.00 on Tax Map 021-00-0, approximately plus/minus three acres, be acquired for the construction of a new Fire Station in the Joelton area; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the purchase of said property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Director of Public Property, or his designee, is hereby authorized to exercise the option to purchase the property (a portion of Davidson County Tax Map 021-00-0 Parcel 036.00) as approximately shown in Exhibit B and to execute the necessary documents pertaining thereto.

Section 2. That any amendments to this resolution shall be approved by the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
