RESOLUTION NO. RS2011-43

Resolution confirming the apportionment of special assessments to certain properties located within the development known as Biltmore Ridges and located at the intersection of Interstate 40 and McCrory Lane.

WHEREAS, by Substitute Resolution RS2011-1, adopted by the Metropolitan County Council (the “Council”) on October 4, 2011, the costs of certain public improvements and other related costs were apportioned to the properties within the development known as Biltmore Ridges and located at the intersection of Interstate 40 and McCrory Lane; and

WHEREAS, Sections 7-32-101 et seq., Tennessee Code Annotated, require that notice of said apportionment be published, that property owners be given the right to object thereto, and that the Council confirm said apportionment after reviewing any such objections; and

WHEREAS, the Metropolitan Clerk has published notice that said apportionment has been approved and that objections thereto may be filed in her office; and

WHEREAS, the Metropolitan Clerk has provided the Council with copies of any objections filed with her office and the Council has reviewed any such objections; and

WHEREAS, the Council wishes to confirm the apportionment of costs approved by Substitute Resolution RS2011-1.

NOW THEREFORE, BE IT RESOLVED BY THE METROPOLITAN COUNTY COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council hereby confirms the apportionment of costs previously approved by Substitute Resolution RS2011-1.
Section 2. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.
