RESOLUTION NO. RS2011-35

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury and property damage claims of Timothy T. Mower against The Metropolitan Government of Nashville and Davidson County.

WHEREAS, on August 3, 2010, a Metropolitan Public Works vehicle operated by a Metropolitan Government employee was exiting I-40 at Church Street when the brakes failed on his vehicle causing a chain reaction accident which totaled Timothy Mower’s vehicle, resulting in personal injury to Mr. Mower and property damage to his vehicle; and,

WHEREAS, after investigation, the Department of Law believes the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the personal injury claim be compromised and settled for $20,000.00, and that the property damage claim be compromised and settled for $16,403.66 and that these amounts be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the personal injury claim of Timothy T. Mower for the sum of $20,000.00 and is authorized to compromise and settle the property damage claim of Timothy T. Mower for the sum of $16,403.66, and that said amounts be paid out of the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
