RESOLUTION NO. RS2011-34

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Yolanda Mitchell against the Metropolitan Government of Nashville and Davidson County, in the amount of $30,000, and that said amount shall be paid out of the Self-Insured Liability Fund.

WHEREAS, a lawsuit has been filed against the Metropolitan Government and Officer Jonathan Smith because Officer Smith injured Yolanda Mitchell in the course of his employment; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that the claim be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Yolanda Mitchell against the Metropolitan Government of Nashville and Davidson County for the sum of $30,000.00. This amount shall be paid out of the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
