RESOLUTION NO. RS2011-30

A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County and the City of Forest Hills concerning removal and relocation of a water main near Cliftee Drive.

WHEREAS, the City of Forest Hills (“Forest Hills”) is undertaking a project to repair certain portions of Cliftee Drive which were damaged by a landslide following the May 2010 flood (the “Project”) and has competitively bid all of the work required for the Project; and,

WHEREAS, the Project requires the removal and relocation of a certain eight (8) inch water main located within the Cliftee Drive right of way (“the Water Main Project”) which would otherwise be the responsibility of the Metropolitan Department of Water and Sewerage Services; and,

WHEREAS, Forest Hills has determined, and the Metropolitan Government has agreed, that the total reimbursable cost for the Water Main Project will not exceed sixty-one thousand dollars ($61,000); and,

WHEREAS, pursuant to the terms of the agreement (the “Agreement”) attached to this resolution as Exhibit 1, the Metropolitan Government and Forest Hills have agreed that the portion of the Project relating to the Water Main Project will be assigned to Forest Hills and a sum equal to the actual cost of the Water Main Project, but not to exceed sixty-one thousand dollars ($61,000) will be paid to Forest Hills to complete the Water Main Project; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., authorizes the governing bodies of political subdivisions of the state to approve cooperative agreements by resolution; and,

WHEREAS, it is in the best interests of the Metropolitan Government that the Agreement be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement is hereby approved and execution thereof by the Director of the Department of Water and Sewerage Services is authorized.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.
