RESOLUTION NO. RS2011-28

A resolution to acquire additional or different easements or property rights for use in public projects of the Metropolitan Government of Nashville and Davidson County, with relation to Project Number 10-SG-220, Munn Road Pump Station (unnumbered) (Proposal No. 2010M-030ES-002).

WHEREAS, Ordinance No. BL2011-947 approved the acquisition of a easement for an upgrade to the Munn Road Pump Station in relation to Project Number 10-SG-220; and,

WHEREAS, it has become evident that additional or different easements or property rights are necessary to permit the construction or other use of water mains, sanitary sewers, reservoirs, stormwater and/or appurtenances within the area designated for the construction of Project No. 10-SG-220, Munn Road Pump Station; and,

WHEREAS, Ordinance No. BL2011-947, Section 5 stated that “acquisition of additional or different easements or additional properties for this project shall be approved by resolution.”

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property Administration is hereby authorized to acquire by negotiation or condemnation the following additional or differently described easements and properties for the purpose of construction or other use of water mains, sanitary sewers, reservoirs, stormwater and/or appurtenances, the initial such project being Project No. 10-SG-220, the same being for a public purpose and the public convenience requiring it.

Section 2. The easement and property to be acquired are shown on the plans for Project No. 10-SG-220, Munn Road Pump Station, on record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein, and the property address and map and parcel number is as follows:

Section 3. The Director of Public Property Administration is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the interests in real property described herein in the name of The Metropolitan Government of Nashville and Davidson County for the construction or other use of water mains, sanitary sewers, reservoirs, stormwater and/or appurtenances.

Section 4. All necessary and incidental costs of the easements herein authorized to be acquired shall be paid from funds authorized from the Extension and Replacement Fund.

Section 5. Acquisition of additional or different easements or additional properties for this project shall be approved by resolution.

Section 6. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
