RESOLUTION NO. RS2011-123
A resolution to establish a new fee structure for all Metro Planning Commission zoning code related applications (Proposal No.2012OT-001-001).
WHEREAS, pursuant to the authority of Section 17.40.760 of the Metropolitan Code of Laws, the Planning Department has developed for the Metropolitan Council’s consideration a new fee structure for zoning applications; and
WHEREAS, pursuant to Section 17.40.740 of the Metropolitan Code of Laws, the adoption of a new fee structure may be accomplished by resolution; and
WHEREAS, Section 17.40.130 E and Section 17.40.140 E of the Metropolitan Code of Laws allows the Planning Department to approve modifications within Urban Design Overlay and Institutional Overlay Districts, respectively, but no fee is currently being charged for the application; and
WHEREAS, a new fee structure has been proposed by the Metro Planning Department and reviewed by the Metro Finance Department;
WHEREAS, the Metro Council finds based on the Planning Department’s recommendation, it fitting and proper to revise the zoning application fees in order to create consistency within design based zoning districts.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the application fee schedule attached as Exhibit A is hereby approved and adopted for zoning code related applications.
Section 2. That this Resolution shall take effect upon its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
