RESOLUTION NO. RS2011-117

A resolution authorizing the Metropolitan Mayor to assign the Certifying Officer authority to the Metropolitan Development and Housing Agency regarding applicable requirements of the National Environmental Policy Act of 1969 with regard to Housing and Urban Development funds administered by the Metropolitan Development and Housing Agency on behalf of Metropolitan Nashville and Davidson County.

WHEREAS, the Metropolitan Development and Housing Agency (MDHA) is the lead agency for administering the Housing and Urban Development (HUD) Consolidated Plan as a direct recipient of HUD; and

WHEREAS, the National Environmental Policy Act of 1969 (NEPA) [42 U.S.C. 4321 et seq.] requires an evaluation of the environmental impact of and alternatives to federal undertakings significantly affecting the environment; and

WHEREAS, HUD regulations governing the environmental review requirements of NEPA are found at 24 C.F.R. Part 58 and require a Certifying Officer to undertake certain acts, and the Metropolitan Mayor, as the Chief Elected Official of Metropolitan Nashville and Davidson County is such Certifying Officer; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Mayor is hereby authorized to assign the Certifying Officer authority to the Executive Director of MDHA, or his or her designee, to perform environmental reviews required by HUD regarding Exempt Activities and Categorically Excluded Activities as those activities are defined in 24 C.F.R. Part 58, Environmental Review Procedures for Entities Assuming HUD Environmental Responsibilities, or its successor provisions, in accordance with the requirements of NEPA and any applicable federal law or regulations.

Section 2. This Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
