RESOLUTION NO. RS2011-116

A resolution authorizing the Metropolitan Mayor to submit an Annual Update to the Consolidated Plan for Housing and Community Development programs to the U.S. Department of Housing and Urban Development.

WHEREAS, the Metropolitan Development and Housing Agency (“MDHA”) is responsible for the preparation of the Consolidated Plan for Housing and Community Development programs for The Metropolitan Government of Nashville and Davidson County; and

WHEREAS, the Metropolitan Council approved Ordinance BL 2009-599 authorizing the Mayor to submit the 2010-2015 Five Year Consolidated Plan for Housing and Community Development; and

WHEREAS, HUD requires annual updates to the Five Year Consolidated Plan and the current year Action Plan providing the public participation process as outlined in the Consolidated Plan is followed; and

WHEREAS, Public Comment period is underway and a public hearing on the Annual Update to the Consolidated Plan was held on November 21, 2011, at the Randee Rogers Training Center, 1419 Rosa L. Parks Blvd.; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Mayor is hereby authorized to submit an Annual Update to the 2010-2015 Five Year Consolidated Plan for Housing and Community Development to the U.S. Department of Housing and Urban Development.

Section 2. A description of the Annual Action Plan for the expenditure of Community Development Block Grant (“CDBG”), HOME Investment Partnerships Program (“HOME”), Emergency Solutions Grant (“ESG”), and Housing Opportunities for Persons with AIDS (“HOPWA”) funds for the program years 2012-2013 is attached hereto and made a part of this Resolution.

Section 3. That the Metropolitan Development and Housing Agency is authorized to administer the Consolidated Plan on behalf of the Metropolitan Government of Nashville and Davidson County.

Section 4. The local match required for ESG funds will be provided by local non-profit organizations selected as sub-grantees. Non Federal funds will be used as necessary to provide the twenty-five percent local match for the HOME Program.

Section 5. If any changes occur in the final entitlement amounts as shown in the attachments to this Resolution, each line in the proposed program not specifically regulated by contracts or agreements with the U.S. Department of Housing and Urban Development shall be revised in accordance with the procedures in the Five Year Consolidated Plan.

Section 6. The Metropolitan Council expressly withholds any approval for the expenditure of funds associated with the CDBG, HOME, ESG, and HOPWA programs for any acquisition of real property by use of eminent domain, which is already restricted by federal law.

Section 7. This Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
