RESOLUTION NO. RS2011-106

A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 7823 with the Tennessee Department of Transportation for Project No. 19959-2582-94 to construct PIN Number 106015.00, Westlawn Drive bridge over branch at log mile 0.41 in Davidson County.

WHEREAS, the Tennessee Department of Transportation (“TDOT”) plans to construct State Project No. 19959-2582-94 in Davidson County; and,

WHEREAS, Tennessee Code Annotated Section 12-9-104(a)(2)(b) allows the governing body of a public agency to approve an agreement with another public agency by resolution; and,

WHEREAS, the Department of Water and Sewerage Services desires construction of the utility work identified as Project No. 10-SG-0005 and 10-WG-0003 in Capital Improvement Budget No. 09-WS-0016 and described in the attached contract; and,

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 7823, attached hereto as Exhibit A, the Metropolitan Government will be responsible for the cost of the utility work which is currently estimated to be $19,050; and,

WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County (the “Metropolitan Government”) that this utility work be carried out in the TDOT project.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Utility Relocation Contract No. 7823 with TDOT, attached hereto as Exhibit A and incorporated herein, is approved and the Metropolitan Mayor is authorized to execute it on behalf of the Metropolitan Government.

Section 2. That the Director of Water and Sewerage Services is authorized to complete and sign additional documents necessary to implement the Local Government Investment Pool Program, relative to this project.

Section 3. That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
