RESOLUTION NO. RS2011-105

A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 7830 with the Tennessee Department of Transportation for Project No. 94053-2221-14 to construct PIN#: 102915.02 along Concord Road between Sunset Road and Nolensville Pike in Williamson and Davidson Counties.

WHEREAS, the Tennessee Department of Transportation (“TDOT”) plans to construct State Project No. 94053-2221-14 in Williamson and Davidson Counties, along Concord Road between Sunset Road and Nolensville Pike, which will require the relocation of utilities, as described in the attached contract (Project Nos. 07-SG-0195 and 07-WG-0126 in Capital Improvement Budget No. 09-WS-0016); and,

WHEREAS, Tennessee Code Annotated Section 12-9-104(a)(2)(b) authorizes the governing body of a public agency to approve an agreement with another public agency by resolution; and,

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 7830, attached hereto as Exhibit A, the Metropolitan Government is responsible for approximately $101,046, which represents eighty-eight percent (88%) of the estimated cost of the utility work; and,

WHEREAS, it is the desire of the Department of Water and Sewerage Services, and in the best interest of the citizens of the Metropolitan Government, that this utility work be carried out in State Project No. 94053-2221-14.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Mayor is authorized to enter into Utility Relocation Contract No. 7830 with the Tennessee Department of Transportation, attached hereto as Exhibit A, and incorporated herein.

Section 2. That the Director of Water and Sewerage Services is authorized to sign and complete any documentation necessary to implement the Local Government Investment Pool Program, relative to this Project.

Section 3. That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
