RESOLUTION NO. RS2011-103

A resolution approving an agreement with Red River Ranch, LLC to provide services, labor, equipment, materials and supplies for the processing, disposal and recycling of wood and yard waste.

WHEREAS, pursuant to section 2.01 of the Metropolitan Charter, the Metropolitan Government has the authority to “collect and dispose of garbage and other refuse . . . ;” and,

WHEREAS, pursuant to its authority under section 2.01 of the Metropolitan Charter and the terms of the agreement (the “Agreement”) attached hereto as Exhibit A, the Metropolitan Government proposes to contract with Red River Ranch, LLC to provide services, labor, equipment, materials and supplies for the processing (grinding) of wood and yard waste into mulch and disposal (through recycling) of it as needed to operate on a day-to-day basis the Metropolitan Government’s compost facility located off of County Hospital Road; and,

WHEREAS, Section 4.12.220 of the Metropolitan Code of Laws calls for Council approval by resolution of certain contracts “providing for the collection, transportation and/or disposal of solid waste;” and,

WHEREAS, approval of the Agreement will benefit the citizens of Davidson County by providing an economical and efficient means of disposing of wood and yard waste by recycling it.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Agreement between The Metropolitan Government of Nashville and Davidson County and Red River Ranch, LLC, attached hereto and incorporated herein, is hereby approved.

Section 2. Any amendments, renewals, or extension of the terms of the Agreement must be approved by resolution of the Metropolitan Council.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
