RESOLUTION NO. RS2011-102

A resolution to acquire additional or different property rights for Munn Road Pump Station, Project Number 10-SG-220 (Proposal No. 2010M-030ES-003).

WHEREAS, Ordinance No. BL2011-947 approved the acquisition of an easement for an upgrade to Munn Road Pump Station, Project Number 10-SG-220; and,

WHEREAS, additional or different property rights may be necessary to permit the construction or other use of a pump station, water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances within the area designated for Project No. 10-SG-220, Munn Road Pump Station; and,

WHEREAS, Section 5 of Ordinance No. BL2011-947 stated that “acquisition of additional or different easements or additional properties for this project shall be approved by resolution.”

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property Administration is hereby authorized and directed, if necessary, to acquire property rights by negotiation or condemnation for use in conjunction with a pump station, water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances for Project No. 10-SG-220, the same being for a public purpose and the public convenience requiring it.

Section 2. The property rights authorized to be acquired are located at 0 Munn Road in Council District 15 and on map and parcel number 08514000500 as indicated on the attached map.

Section 3. All necessary and incidental costs of the easements herein authorized to be acquired shall be paid from authorized funds within the Extension and Replacement Fund.

Section 4. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
