RESOLUTION NO. RS2011-1807
A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Nora Davis, Debra Tuders, Ben Upton, and Elizabeth Upton against the Metropolitan Government of Nashville and Davidson County in the amount of $195,000.00, and that said amount be paid out of the Self-Insured Liability Fund.
WHEREAS, on June 8, 2009, a vehicle owned by the Metropolitan Government and operated by a Nashville Public Library employee struck Nora Davis’ car, whose car then struck Ben Upton’s car, causing damages to Nora Davis, Debra Tuders, Ben Upton, and Elizabeth Upton; and,
WHEREAS, after investigation, the Metropolitan Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that the claim be compromised and settled.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Nora Davis for $65,000.00, Debra Tuders for $15,000.00, and Ben and Elizabeth Upton for $115,000.00 for the sum of $195,000.00, which shall be paid out of the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
