RESOLUTION NO. RS2011-1779

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Steven D. Albright and Kathy D. Albright, on behalf of the Estate of Shellie Albright Hernandez, against the Metropolitan Government of Nashville and Davidson County in the amount of $150,000.00, and that said amount be paid out of the Self-Insured Liability Fund.

WHEREAS, a lawsuit has been filed against the Metropolitan Government due to the failure of a Metropolitan Government Community Corrections employee to file probation violation reports to revoke the Community Corrections probation of Michael Williams, who murdered Shellie Albright Hernandez while on Community Corrections probation; and,

WHEREAS, after investigation the Metropolitan Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that the claim be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Steven D. Albright and Kathy D. Albright, on behalf of the Estate of Shellie Albright Hernandez, for the sum of $150,000.00. This amount shall be paid out of the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
