RESOLUTION NO. RS2011-1764

A resolution accepting the resignation of Criminal Court Clerk David C. Torrence.

WHEREAS, on July 6, 2011, Davidson County Criminal Court Clerk David C. Torrence submitted a Service Pension Application Request to the Metropolitan Department of Human Resources applying for an Early Service Pension to be effective July 16, 2011, a copy of which is attached hereto and incorporated herein as “Attachment 1”; and

WHEREAS, on July 12, 2011, District Attorney General Victor S. (Torry) Johnson III submitted a letter to Metropolitan Vice Mayor Diane Neighbors giving notice of Mr. Torrence’s intention to resign from the office of the Criminal Court Clerk of Davidson County effective July 15, 2011 at 11:00 a.m., a copy of which is attached hereto and incorporated herein as “Attachment 2”; and

WHEREAS, pursuant to Article VII, Section 2 of the Tennessee Constitution, vacancies in county offices are to be filled by the county legislative body until the next election occurring after the vacancy; and

WHEREAS, the Davidson County Criminal Court Clerk is a county office for purposes of Article VII, Section 2 of the Tennessee Constitution; and

WHEREAS, the Metropolitan Council desires to accept the resignation of Criminal Court Clerk David C. Torrence and commence the process for filling the vacancy in accordance with the Council Rules of Procedure.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council hereby accepts the resignation of David C. Torrence from the office of the Criminal Court Clerk of Davidson County.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to District Attorney General Victor S. (Torry) Johnson III, to Director of Law Sue B. Cain, to Tennessee Attorney General Robert E. Cooper, and to David C. Torrence.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
