RESOLUTION NO. RS2011-1757

A resolution authorizing an amendment to an agreement between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County for the Mill Creek Watershed Feasibility Study, and authorizing all necessary officials to execute the same.

WHEREAS, the United States Department of the Army has offered an amendment to the Metropolitan Government of Nashville and Davidson County, by and through the Department of Water and Sewerage Services, for an increase in costs and scope for the Mill Creek Watershed Feasibility Study; and,

WHEREAS, BL2003-1365 authorized the acceptance of the contract for the feasibility study work; and,

WHEREAS, the amendment is offered to include the costs of flood insurance study (FIS) updates for Mill Creek along with flood damage reduction alternative analysis utilizing the updated information from the FIS; and,

WHEREAS, the additional cost contemplated by the amendment will be shared between the Metropolitan Government and the United States Department of the Army, with the Metropolitan Government’s additional share not exceed $134,000; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that said amendment be accepted.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the amendment to the agreement between the United States Department of the Army and the Metropolitan Government for the Mill Creek Watershed Feasibility Study, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2: That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
