RESOLUTION NO. RS2011-1723

A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County and the City of Belle Meade concerning street paving in connection with water line replacement along and near Belle Meade Boulevard.

WHEREAS, the Metropolitan Government, by and through its Department of Water and Sewerage Services, undertook, through a competitively procured contract (the “Contract”) with Lojac Enterprises, to repair and refurbish (the “Project”) the public water distribution system along and near Belle Meade Boulevard; and,

WHEREAS, the Project required excavation within the paved portion of Belle Meade Boulevard and nearby streets and subsequent milling and repaving (collectively, the “Paving Work’); and,

WHEREAS, the Metropolitan Government has determined and the City of Belle Meade has agreed that the total cost of the Paving Work under the Contract is five hundred eight thousand two hundred thirty-four dollars ($508,234) (“Paving Funds”); and,

WHEREAS, pursuant to the terms of the agreement (“Agreement”) attached to this resolution as Exhibit 1, the Metropolitan Government and the City of Belle Meade have agreed that the portion of the Contract relating to the Paving Work will be assigned to Belle Meade and a sum equal to the Paving Funds shall be paid to Belle Meade to complete the Paving Work; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., authorizes the governing bodies of political subdivisions of the state to approve cooperative agreements by resolution; and,

WHEREAS, it is in the best interests of the Metropolitan Government that the Agreement be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.
