RESOLUTION NO. RS2011-1704
A resolution approving an intergovernmental license agreement with the State of Tennessee, Department of Transportation in relation to the Gateway to Heritage Phase I streetscape improvements for I-40 Exits off Jefferson Street and 28th Avenue North.
WHEREAS, the Metropolitan Government of Nashville and Davidson County accepted a grant from the State of Tennessee, Department of Transportation (“TDOT”), Pin No. 103419, by Resolution No. RS2008-515, which provides funds for improvements to off ramps along I-40 at Jefferson Street and 28th Avenue North; and,
WHEREAS, the grant requires the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, to be responsible for maintenance and operations of all project improvements; and,
WHEREAS, the grant requires the Metropolitan Government to accept the TDOT intergovernmental encroachment license agreement for construction and operation of all streetscape improvements within the State right-of-way off ramps along I-40 at Jefferson Street and 28th Avenue North; and,
WHEREAS, pursuant to the terms of the intergovernmental license agreement with TDOT, attached hereto as Exhibit A, The Metropolitan Government of Nashville and Davidson County accepts a license to operate and maintain all project landscaping improvements within State right of way; and,
WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter agreements with the State of Tennessee by resolution; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental license agreement be approved.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The intergovernmental license agreement between The Metropolitan Government of Nashville and Davidson County and TDOT, attached hereto and incorporated herein as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute said agreement.
Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.
Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
