RESOLUTION NO. RS2011-1703

A resolution authorizing the Metropolitan Government of Nashville and Davidson County to enter into Amendment One to the existing agreement with the City of La Vergne for acceptance and treatment by the Metropolitan Government of Nashville and Davidson County for sewage flow from the City of La Vergne’s sewage collection system.

WHEREAS, the Metropolitan Government of Nashville and Davidson County previously entered into an agreement with the City of La Vergne for acceptance and treatment by the Metropolitan Government of Nashville and Davidson County for sewage flow from the City of La Vergne’s sewage collection system approved by RS2009-1063; and,

WHEREAS, the Metropolitan system has or will have sufficient capacity to safely and effectively accept and treat sewage flows from the City of La Vergne as contemplated; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., ("The Interlocal Cooperation Act") authorizes political subdivisions of the state to enter into cooperative agreements by resolution of the local governing body; and,

WHEREAS, Amendment One to the Agreement has been approved by the Mayor and Board of Aldermen of the City of La Vergne and executed by the Mayor of the City of La Vergne; and,

WHEREAS, it is the best interests of The Metropolitan Government of Nashville and Davidson County to enter into Amendment One to the Agreement with the City of La Vergne.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment One to the Agreement by and between the City of La Vergne and The Metropolitan Government of Nashville and Davidson County, a copy of Amendment One is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
