RESOLUTION NO. RS2011-1665

A resolution authorizing the execution of an encroachment agreement with CSX Transportation, allowing the Department of Water and Sewerage Services to construct and maintain water and sewer lines in the railroad right-of-way for the Washington CSO Facility.

WHEREAS, CSX Transportation proposes to permit the Department of Water and Sewerage Services to construct and maintain water and sewer lines in the railroad right-of-way in connection with the Washington CSO Facility pursuant to the terms of the encroachment agreement, attached in substantial form as Exhibit A; and,

WHEREAS, Ordinance No. O98-1393 authorizes the Metropolitan Government of Nashville and Davidson County to enter these types of agreements with CSX for water and sewer line construction by resolution; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The encroachment agreement between the Metropolitan Government of Nashville and Davidson County and CSX Transportation, Inc., attached hereto in substantial form as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute it.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

I move to amend Resolution No. RS2011-1665 by substituting the attached Exhibit A for the current Exhibit A to RS2011-1665, the Encroachment Agreement between The Metropolitan Government of Nashville and Davidson County and CSX Transportation, Inc.
