RESOLUTION NO. RS2011-1664

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for a Signal System Upgrade - Phase 3B at various intersections on Lebanon Pike, Central Pike, and Old Hickory Boulevard in the Hermitage Area in Davidson County, PIN 115234.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County seeks to enter into an intergovernmental agreement with the State of Tennessee Department of Transportation for a Metro signal system upgrade - Phase 3B at various intersections on Lebanon Pike, Central Pike, and Old Hickory Boulevard in Davidson County at an estimated cost of $1,100,000, PIN 115234.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for a Metro signal system upgrade - Phase 3B in Davidson County, PIN Number 115234.00, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any funds obtained by the metropolitan government pursuant to this intergovernmental agreement shall be appropriated to the Metropolitan Department of Public Works based on the revenues estimated to be received and any match to be applied.

Section 3. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
