RESOLUTION NO. RS2011-1635
A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County and the City of Lakewood concerning the assumption of certain responsibilities and the disposition of assets and liabilities in connection with the surrender of the City of Lakewood’s charter.
WHEREAS, by referendum held March 15, 2011, the voters of the City of Lakewood approved the surrender of the city charter; and
WHEREAS, the Metropolitan Government and the City of Lakewood desire an orderly transition of governmental responsibilities; and
WHEREAS, pursuant to the agreement (the “Agreement”) attached as Exhibit 1 to this resolution, the Metropolitan Government and the City of Lakewood seek to confirm the disposition of the City of Lakewood’s assets and liabilities and the assumption of certain responsibilities upon the termination of the City of Lakewood’s charter; and
WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., authorizes the governing bodies of political subdivisions of the state to approve cooperative agreements by resolution; and
WHEREAS, it is in the best interests of the Metropolitan Government that the Agreement be approved.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Agreement is hereby approved.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.
