RESOLUTION NO. RS2011-1619

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s property damage claim against Taxi USA of Tennessee, LLC.

WHEREAS, on December 13, 2010, Christy Baker, an employee of the Metropolitan Nashville Fire Department, while operating a Metropolitan Government vehicle in the course and scope of her employment, was exiting the I-24 West ramp onto Harding Place when the vehicle was struck on the driver’s side in the rear by a vehicle operated by an employee of Taxi USA of Tennessee LLC, who failed to stop at the red light resulting in damage to the Metropolitan Government vehicle; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the Metropolitan Government accept payment in the amount of $9,290.67 as compensation for all damages to Metropolitan Government property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle its recovery claim against Taxi USA of Tennessee, LLC in an amount totaling $9,290.67, which shall be deposited into an appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
