RESOLUTION NO. RS2011-1537

A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase real property (Map 107-13 Parcel 018.00) for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2011M-001PR-001).

WHEREAS, pursuant to the terms of the agreement attached hereto and incorporated herein as Exhibit A to this resolution, the Metropolitan Government holds an option to purchase certain property known as 1008 Patricia Dr. and located adjacent to Glenview Elementary; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:
Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan government at a fixed price, subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council; and,

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (EXHIBIT A) to acquire real property located in Davidson County being Map No. 107-13-0, Parcel 018.00 (see EXHIBIT B), and incorporated into this resolution by reference; and,

WHEREAS, the Metropolitan Board of Education has approved the acceptance of the Property; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the purchase of said property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to execute the necessary documents to acquire by negotiation or condemnation portions of the property identified as Parcel 018.00 on Davidson County Tax Map 107-13-0, and as shown in Exhibit "B" hereto.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
